A notice from the President’s Secretary to the heads of government institutions

Ministry Secretaries, Provincial Chief Secretaries, Heads of Departments, Heads of State Corporations and Statutory Boards or lower level officials in relation to judicial matters or matters incidental thereto in which the Government or public officials are parties, the Supreme Court judges including the Chief Justice, the Judicial Service Commission or judicial officers ( President’s Secretary Mr. Saman Ekanayake has informed the heads of government institutions that they should refrain from direct correspondence with High Court Judges, District Judges and Magistrates).

This notification has been made by sending a letter today (15) to all Ministry Secretaries, Provincial Chief Secretaries, Heads of Departments, District Secretaries, Heads of State Corporations and Statutory Boards. In relation to those matters, care should be taken to transact letters only with the Attorney General’s Department as per the provisions of Chapter XXVII of the Institutions Code and the related public administration circular instructions.

If dealing with the Attorney General’s Department regarding matters other than the above, those correspondence should be done through the President’s Office only. The provisions of this circular regarding correspondence between the Ministry of Justice or other government agencies with the Judicial Service Commission, the Attorney General’s Department and judicial officers in relation to their scope of day-to-day general administration and complaints submitted by judicial officers to the Judicial Service Commission. The letter has further informed that it is not applicable.
